General Terms and Conditions of beach me GmbH
- hereinafter referred to as Beach me.
1. registration, confirmation
1.1 With your registration, you offer Beach me the binding conclusion of a contract for participation in the event named in the registration form. The contract is concluded when we confirm your booking of the event in writing. Agreements made by telephone or verbally shall only become binding when confirmed by us in writing.
1.2 The registration is made by the registrant also for all participants listed in the registration/list
, for whose contractual obligations the registrant is liable as for his own obligations
1.3 Participation in Beach me beach volleyball camps is possible for all adults 18 years and older. Younger participants can only take part in Beach me beach volleyball camps advertised as youth camps.
2. payment
2.1 With the registration the participant fee according to the booked service per person is due. Upon receipt of the invoice by Beach me, a deposit of at least 30 percent of the participant fee must be paid within 2 weeks. The balance must be paid no later than four weeks before the start of the event. Fees in case of cancellation, processing and rebooking fees are due immediately. The amounts for deposit and balance payment as well as cancellation, if applicable, result from the booking confirmation. Payments shall be made in one sum for all registered participants.
2.2 In the case of bookings at short notice (four weeks or more before the start of the event), the entire participant fee is due immediately.
2.3 In the event of non-compliance with the final payment date, Beach me may withdraw from the existing booking contract after unsuccessful reminder with a grace period and demand withdrawal fees as compensation in accordance with section 3.2. The final information will only be handed out after receipt of the final payment, but no earlier than 14 days before the start of the event.
3. withdrawal by the participant(s), cancellation fees
3.1 It is possible to withdraw from participation at any time before the start of the event. The date of receipt of the notice of withdrawal by Beach me is decisive. The declaration of cancellation must be made in writing. If a participant/co-traveler withdraws or if the trip to the event is not taken for reasons (with the exception of cases of force majeure regulated under Section 8) for which Beach me is not responsible, Beach me may demand reasonable compensation for the arrangements made and expenses incurred. When calculating the compensation, any expenses usually saved and any other possible use of the event services shall be taken into account. You are at liberty to prove that no costs or significantly lower costs were incurred in connection with the cancellation or non-commencement of the trip than the costs stated by us in the flat rate (see 3.2).
3.2 The following costs are generally payable in the event of withdrawal (including by individual persons) from the event: - up to 30 days prior to the start of the event: 40% of the participant fee - from the 29th to the 15th day prior to the start of the event: 60% of the participant fee - from the 14th to the 6th day prior to the start of the event: 80% of the participant fee - from the 5th day prior to the start of the event: 90% of the participant fee - in the event of no-show at the start of the event: 100% of the participant fee
3.3 Beach me recommends that you take out travel cancellation insurance.
4. withdrawal and termination by Beach me
Beach me may terminate the contract without notice if the participant persistently disrupts the performance of the event despite a warning by Beach me or if the participant behaves in a manner contrary to the contract to such an extent that the immediate termination of the contract is justified. If Beach me cancels the contract, Beach me shall retain the claim to the participation fee less the value of the saved expenses as well as the saved benefits resulting from an alternative use of the services not utilized.
5. travel duration
The duration of the trip is given in whole days. The day of arrival as well as the day of return are considered as whole days.
6. house rules
In accommodations where there are house rules, such as schools, youth hostels, vacation apartments, vacation homes but also hotels, these must be observed.
7. sports program
The organizer and Beach me reserve the right to change the program if there are justified reasons to do so. Beach me accepts no liability for the non-execution or incomplete execution of the program as a result of circumstances beyond Beach me's control.
8 Liability, exclusion of claims and statute of limitations
8.1 The contractual liability for damages that are not bodily injuries is limited to three times the participant fee (per person), insofar as a damage to the participant was caused neither intentionally nor through gross negligence or we are responsible for a damage incurred by the participant solely due to the fault of a service provider. Legal provisions limiting or excluding liability, which are based on international conventions and which may be invoked by a service provider engaged by us, shall also apply in our favor. For all claims for damages in tort against Beach me that are not based on intent or gross negligence, liability for property damage is limited to the amount of three times the participant fee (per person and event).
8.2 In the event of self travel and travel opportunities organized by Beach me, Beach me shall not be liable for any damages, damages, accidents, losses and other irregularities during the outward and return journey to the vacation destination, as Beach me acts here only as an intermediary, i.e. the transport risk is borne here by each participant.
8.3 Beach me is not liable for service disruptions, personal injury and property damage in connection with third-party services that are merely arranged or organized by the participants themselves. Beach me is generally not liable in the event of force majeure.
8.4 Participation in sports and other leisure activities is the responsibility of the participants and fellow travelers. Sports facilities, equipment and vehicles should be checked before use. Beach me is only liable for accidents that occur during sports events and other leisure activities if the company is at fault. Beach me recommends that you take out accident insurance.
8.5 In the event of service disruptions, each participant/co-traveler is obligated to cooperate within the scope of the legal provisions to avoid or minimize any damages. Deficiencies or disruptions are to be reported immediately to the Beach me staff on site, Beach me recommends the written form. If a participant/traveler fails to comply with this obligation through his/her own fault, he/she shall not be entitled to any claims in this respect.
8.6 Beach me employees on site are not entitled to acknowledge any claims.
8.7 Claims for non-contractual performance of the booked event must be asserted to Beach me within one month after the contractually stipulated end of the event. We recommend the written form. After expiration of the deadline, you may only assert claims if you were prevented from meeting the deadline through no fault of your own. Your claims arising from this contract are subject to a limitation period of one year. The limitation period begins with the day on which the event should end according to the contract.
9. exclusion from participation
If it turns out that a participant behaves in such a harassing manner that the relationship between Beach me and the service provider (e.g. transportation, accommodation, organizer) is seriously endangered, the participant in question can be excluded from the trip and must immediately leave the accommodation or the event location at his own expense.
10. covid 19 | options & policies
Participants/co-travelers undertake to inform themselves about the applicable covid 19 | options & policies "2G plus" or "2G" of Beach me. Failure to comply with applicable policies will warrant immediate cancellation of the contract. If Beach me cancels the contract, Beach me shall retain the claim to the participant fee less the value of the saved expenses as well as the saved benefits resulting from an alternative use of the unused service.

11. final provision
The Terms and Conditions shall apply to all agreements between Beach me and the Contractual Partner, regardless of the domiciles of all parties involved and the place where the agreement was concluded and the place where the service is to be provided.
