General Terms and Conditions of beach me GmbH

hereinafter referred to as “Beach me” – as of October 2026

1. Scope and Definitions

1.1 These terms and conditions apply to all contracts between Beach me and you regarding participation in Beach me events.

1.2 For the purposes of these Terms and Conditions, the following terms shall have the meanings set forth below:

•           Event: Any activity organized by Beach me, such as beach volleyball camps, weekend camps, and youth camps.
•           Trip: an event that constitutes a package tour as defined in Section 651a of the German Civil Code (BGB), because it includes travel services (in particular, lodging) in addition to the sports program. Events for which such additional travel services are not advertised but are offered during the booking process are not considered trips.
•           Registration fee: the cost of participation per person. For trips, the registration fee is the same as the trip price.
•           Booker: the person making the reservation (also referred to as “you” in these terms and conditions).
•           Participants: All individuals who are scheduled to attend the event, including the person who made the reservation.
•           Service Providers: Third parties that Beach me engages to provide services (e.g., resorts, hotels, campgrounds, sports facilities, transportation companies).

1.3 Where these Terms and Conditions refer to “events,” they also apply to travel. Provisions that apply only to travel are marked with “For travel.” In addition, the statutory provisions governing package travel contracts (Sections 651a et seq. of the German Civil Code (BGB)) apply to travel. These Terms and Conditions do not deviate from those provisions to the detriment of travelers.

2. Registration, Conclusion of the Contract, and Minimum Age

2.1 Offer and Confirmation. By registering, you are making a binding offer to Beach me to enter into a contract for participation in the event specified in the registration form. The contract is concluded when Beach me confirms your booking in writing (e.g., by email) (booking confirmation).

2.2 Agreements and Requests. Agreements made by phone or verbally, as well as requests made in the notes field of the reservation, are not binding until Beach me updates the reservation details accordingly or confirms them in writing.

2.3 Group Registration. By submitting your registration, you are also registering all participants listed in the registration form or list. You are responsible for their contractual obligations just as you are for your own.

2.4 Minimum Age. Participation is open to adults 18 years of age and older. Younger participants may only participate if:

1. a) events advertised as youth camps, as well as
2. b) at camps offering the “Next Generation Program” as an additional option, provided they are accompanied by at least one parent or legal guardian.

3. Benefits, Duration, and Changes to Benefits

3.1 Scope of Services. The scope of services is set forth in the event description and the booking confirmation.

3.2 Duration. The duration of the event or trip is specified in full days. The day of arrival and the day of departure are counted as full days.

3.3 Reservation Regarding Minor Changes to Services. Beach me reserves the right to modify individual agreed-upon services or program content after the contract has been concluded. This is permitted only if

1. a) there is an objective reason (e.g., weather conditions, availability of sports facilities or accommodations, regulatory requirements, absence of coaches or key players, safety of participants),
2. b) the change is insignificant, meaning that it does not affect the overall nature or the essential features of the event, and
3. c) the change is reasonable for you.

Beach me will notify you in writing of any such changes.

3.4 Substantial Changes. If Beach me must make a substantial change to a key service before the event begins, Beach me will notify you of this immediately in writing. The notification will include

1. a) the change and its impact on the event,
2. b) a reasonable period of time within which you can make your decision, and
3. c) a notice explaining the consequences if you do not respond within the deadline.

Within the deadline, you can

1. a) approve the amendment,
2. b) withdraw from the contract free of charge, or
3. c) request to participate in an alternative event, provided that Beach me offers one.

If you do not respond within the specified time frame, the change will be deemed accepted. For travel, your additional rights under Section 651g of the German Civil Code (BGB) remain unaffected.

3.5 No Price Changes. After the contract is concluded, Beach me will not change the participation fee for the booked services. This applies to the scope of services agreed upon in the contract. Separately booked additional services are not affected.

3.6 On-site adjustments. The Beach me team will notify participants on site of any last-minute adjustments during the event (e.g., rescheduling of training times or changes to playing fields due to weather conditions). Legal rights regarding defects remain unaffected (Section 10).

4. Payment and Insolvency Protection

4.1 Payment Due Date. The participation fee is based on the service booked per person. It is due as follows:

1. a) Deposit: within two weeks of receiving the booking confirmation,
2. b) Final payment: no later than four weeks before the event begins.

4.2 Last-minute bookings. For last-minute bookings (made within four weeks before the start of the event), the full participation fee is due immediately. It must be paid

1. a) within 7 days and
2. b) no later than 2 days before the event begins.

4.3 Fees Due Immediately. Fees in the event of a cancellation, as well as processing and rebooking fees, are due immediately.

4.4 Amounts and Payment Method. You can view the amounts for the deposit, final payment, and, if applicable, cancellation fees at any time in the booking system’s customer portal. You’ll find the link to the portal in your booking confirmation. Payments must be made in a single lump sum for all registered participants via bank transfer.

4.5 Late Payment. If you fail to meet the deadline for the down payment or the final payment, Beach me may terminate the contract after issuing a reminder and setting a grace period, should the payment remain outstanding. Beach me may then charge cancellation fees in accordance with Section 5.3 as compensation.

4.6 Travel Insolvency Protection. When traveling, your payments are legally protected in the event of Beach me’s insolvency. Beach me will only accept payments toward the travel price before the end of the trip upon presentation of a travel insurance certificate (Sections 651r, 651t of the German Civil Code (BGB)). 5. Withdrawal, Substitute Participants, and Cancellation Fees

5.1 Cancellation. You may cancel your participation at any time before the event begins. This also applies to individual participants in a booking for multiple people. The cancellation notice must be submitted in writing (e.g., by email). The date of receipt by Beach me (Section 13) is decisive.

5.2 Compensation. If you cancel or if the event does not take place for reasons beyond Beach me’s control, Beach me may demand reasonable compensation for the arrangements made and expenses incurred. This does not apply to the cases described in Section 9.4 (unavoidable, extraordinary circumstances). The following applies to the calculation of compensation:

1. a) Expenses that would normally have been saved and a normally feasible alternative use of the event services are taken into account.
2. b) Beach me claims compensation on a lump-sum basis in accordance with Section 5.3.
3. c) You are free to prove that, in connection with the cancellation or failure to check in, no costs were incurred, or that the costs incurred were significantly lower than those specified in Section 5.3.

5.3 Cancellation Schedule. In the event of cancellation of the event (including cancellation by individual participants in a group booking), the following cancellation fees generally apply:

•             Up to 30 days before the event begins: 40% of the registration fee
•             From the 29th day until the 15th day before the event begins: 60% of the registration fee
•             From the 14th day to the 6th day before the event begins: 80% of the registration fee
•             Starting 5 days before the event begins: 90% of the registration fee
•             If you do not show up at the start of the event: 100% of the registration fee

5.4 Substitute Participants. You may notify us in writing before the event begins that another person will be attending in your place or in place of another registered participant (substitute participant). The following applies:

2. a) Beach me permits the substitution if the substitute participants take over the exact same services that were booked (same event, same date, same service components) and meet the participation requirements (e.g., minimum age as specified in Section 2.4).
3. b) In this case, no cancellation fees under Section 5.3, nor any processing or rebooking fees, will apply.
4. c) For trips, notification is considered timely if it is received by Beach me no later than 7 days before the start of the trip. After that, a change is possible provided it is still logistically feasible.
5. d) Beach me may demand reimbursement for any additional costs actually and reasonably incurred by Beach me as a result of the change (e.g., fees charged by service providers), in the amount substantiated.
6. e) You and the substitute participants are jointly liable for the participation fee and for these additional costs.

6. Participants’ Responsibilities; House, Park, and Beach Rules

6.1 Compliance with Rules and Regulations. You (as well as all participants you have registered) are required to comply with the applicable regulations, as well as the house rules, facility rules, and beach rules of the respective service providers. These apply at the event venue, at sports facilities, on beach areas, and at accommodations (e.g., camping resorts, hotels, and sports complexes). This includes, in particular:

1. a) specified rest periods (including lunch breaks and nighttime rest),
2. b) Nighttime driving bans,
3. c) Rules regarding waste separation and cleanliness, as well as
4. d) Guidelines for animal husbandry.

6.2 Instructions from Staff. You are required to follow the instructions of Beach me staff and the staff of service providers. This applies to the extent that the instructions are intended to ensure compliance with safety regulations, quiet hours, or order on the premises.

7. Termination and Exclusion from Participation by Beach me

7.1 Termination and Exclusion. Beach me may terminate the contract without notice. Beach me may also exclude you or individual participants in your booking from the event, from specific program activities, or from using the accommodations. This applies if you or a person you have registered

1. a) persistently disrupts the event, notwithstanding a warning from Beach me or its representatives:
2. b) acts in a manner that is in breach of the contract or causes harm to such an extent that immediate termination of the contract is justified,
3. c) intentionally or through gross negligence damages or steals property belonging to Beach me, other participants, or service providers,
4. d) repeatedly or seriously violates the applicable house rules, venue regulations, or quiet hours policies of the service providers, or violates official regulations, or
5. e) behaves in a manner so disruptive that it seriously jeopardizes the relationship between Beach me and a service provider (e.g., transportation, lodging, event organizer).

7.2 No prior warning required. A prior warning is not required if it is evident that the warning would be ineffective or if the violation is particularly serious. Examples of particularly serious violations include, for example,

1. a) Property damage or vandalism,
2. b) the use of force,
3. c) Drug use and
4. d) a serious threat to the safety of third parties.

7.3 Leaving the Accommodation. If a person is expelled from the event or if Beach me terminates the contract, the person in question must leave the accommodation or the event venue immediately and at their own expense.

7.4 Legal Consequences. If Beach me terminates a participant’s participation for conduct-related reasons or excludes a participant, Beach me retains the right to the participation fee. However, Beach me must offset the value of any expenses it has saved. The same applies to any benefits resulting from the alternative use of the unused services.

7.5 Additional Costs. If Beach me incurs additional costs as a result of the cancellation or termination (e.g., for arranging an early departure or due to damage to accommodations), the person responsible for such costs shall bear them. As the person who made the reservation, you are liable for these costs in accordance with your obligation to compensate under Section 2.3.

8. Beach me's Liability

8.1 Travel. For travel, Beach me’s liability is limited to three times the travel price per person with respect to damages that

1. a) there are no physical injuries, and
2. b) are not caused through one’s own fault (Section 651p(1) of the German Civil Code (BGB)).

If international agreements or statutory provisions based on such agreements apply to a travel service and limit or exclude claims, Beach me may also invoke these provisions (Section 651p(2) of the German Civil Code (BGB)). Liability for bodily injury and for damages caused by negligence is governed by statutory provisions.

8.2 For events that do not involve travel. Beach me bears unlimited liability for damages resulting from injury to life, body, or health, as well as in cases of willful misconduct and gross negligence. In cases of simple negligence, Beach me is liable only for breaches of material contractual obligations, limited to foreseeable damages typical for this type of contract. Essential contractual obligations are obligations whose fulfillment is essential for the proper conduct of the event and on whose compliance you may reasonably rely. Otherwise, liability for simple negligence is excluded. Mandatory statutory liability provisions remain unaffected.

8.3 Program and Circumstances Beyond Beach me’s Control. Beach me shall not be liable for the non-performance or incomplete performance of the program if this is due to circumstances for which Beach me is not responsible and which are beyond its control (e.g., weather conditions, closure or unavailability of sports facilities, official orders). Statutory rights regarding defects (in particular, rectification and reduction) remain unaffected.

8.4 Travel to and from the Event. Unless expressly included as part of the event, participants are responsible for arranging their own travel to and from the event venue (independent travel). In cases of independent travel and carpooling opportunities that Beach me merely facilitates, Beach me acts solely as an intermediary. Participants bear the risk of transportation in this regard. Beach me is therefore not liable for damage, accidents, losses, or other irregularities occurring during the round trip. This does not apply to damages resulting from injury to life, limb, or health, or in cases of willful misconduct or gross negligence on the part of Beach me in the arrangement of transportation.

8.5 Third-Party Services. Third-party services are services that are not part of the booked event and that Beach me merely arranges or that participants organize themselves (e.g., excursions, rental cars). Before arranging such services, Beach me will inform participants that it acts solely as an intermediary. Beach me is not liable for service disruptions or for personal injury or property damage related to third-party services. This does not affect liability for breaches of duty in the arrangement of the services themselves in cases of willful misconduct, gross negligence, or bodily injury. Services that are part of the event and provided by service providers are not considered third-party services.

8.6 Personal Responsibility for Sports Activities. Participation in sports and other recreational activities is at your own risk. You should inspect sports facilities, equipment, and vehicles before use. Beach me is liable for accidents occurring during sports events and other recreational activities only in accordance with Sections 8.1 and 8.2—that is, only if Beach me is at fault.

9. Force Majeure and Unavoidable, Extraordinary Circumstances

9.1 Definition. Force majeure and unavoidable, extraordinary circumstances are events that arise from external causes, are beyond Beach me’s control, and could not have been avoided even with the utmost care. These include, in particular,

1. a) Natural disasters and extreme weather conditions,
2. b) War, terrorism, and civil unrest,
3. c) Strikes,
4. d) Epidemics and pandemics,
5. e) official orders (e.g., closures, entry bans, or bans on gatherings), as well as
6. f) the disruption of transportation routes or the energy supply.

9.2 Liability. Beach me shall not be liable for any failure to perform or damages resulting from force majeure or unavoidable, extraordinary circumstances.

9.3 Withdrawal by Beach me. If Beach me is unable to hold the event due to force majeure or unavoidable, extraordinary circumstances, Beach me may withdraw from the contract in writing before the event begins. Withdrawal shall take place immediately upon becoming aware of the impediment. For travel, § 651h(4) of the German Civil Code (BGB) applies. In this case, Beach me will refund any payments already made without delay, no later than 14 days after the withdrawal. No further claims may be asserted unless Beach me is responsible for the circumstances. This applies in particular to the costs of self-organized travel to and from the event, as well as other personal expenses incurred by the participants.

9.4 Cancellation by You for Travel. For travel arrangements, you may cancel before the trip begins without compensation if unavoidable, extraordinary circumstances arise at the destination or in its immediate vicinity that significantly impair the conduct of the trip or the transportation of persons to the destination (Section 651h(3) of the German Civil Code (BGB)).

10. Notice of Defects, Remedies, and Statute of Limitations

10.1 Cooperation. All participants are obligated, in the event of performance disruptions, to cooperate within the scope of statutory provisions to prevent or minimize potential damages.

10.2 Notification of Defects. Any defects or malfunctions must be reported immediately to the Beach me team on site. Beach me recommends that you do so in writing. If you fail to fulfill this obligation through your own fault, you will not be entitled to any claims in this regard.

10.3 Powers of the On-Site Team. The on-site Beach me team is authorized to receive notices of defects. It is not authorized to acknowledge claims.

10.4 Statute of Limitations. For travel, your claims arising from the contract are subject to a two-year statute of limitations (Section 651j of the German Civil Code (BGB)). The limitation period begins on the day the trip was scheduled to end under the terms of the contract. For other events, the statutory limitation periods apply.

11. Participants’ Liability for Damage and Special Cleaning

11.1 Liability for Damages. You (as well as all participants you have registered) are liable to Beach me for any damages caused intentionally or through negligence to

1. a) Accommodations,
2. b) Rental items and sports equipment, as well as
3. c) Inventory and facilities belonging to Beach me or its service providers (e.g., resorts, hotels).

11.2 Special Cleaning. Beach me must be reimbursed for the actual costs incurred for special cleaning and reconditioning if

1. a) the accommodation or equipment provided is left in a state of excessive or unusual soiling upon departure, which goes beyond normal wear and tear and requires special cleaning, or
2. b) the rules of the house are violated (e.g., the smoking ban in the dormitories).

11.3 Indemnification for Contractual Penalties and Fee Claims. If a contractual penalty or fee claim by a service provider against Beach me is triggered by culpable conduct on your part or on the part of the participants you have registered, you shall indemnify Beach me against these costs. Examples include littering on the beach or in common areas and failure to comply with official regulations. This applies only if the damage or violation can be attributed to you or your booking group.

12. Insurance

Beach me recommends purchasing travel cancellation insurance as well as personal accident insurance.

13. Access to Statements

13.1 Notices to Beach me. Any notices you provide to Beach me (e.g., cancellation, notification of substitute participants, notification of defects after the event) must be submitted in writing, such as by email. You should send them to the contact information provided by Beach me at https://beachme.de/kontakt/.

13.2 Receipt. A notice is deemed received as soon as it has come within Beach me’s control via the contact information provided and, under normal circumstances, can reasonably be expected to have come to its attention. You should direct any on-site notices of defects to the Beach me team (Section 10.2).

13.3 Notices from Beach me. Beach me sends notices and information in writing, typically via email to the address provided during registration. You must ensure that Beach me can reach you at this address and must notify Beach me immediately of any changes to your contact information.

14. Final Provisions

14.1 Scope of Application. These terms and conditions apply to all agreements between Beach me and you as a contracting party. This applies regardless of the place of residence of the parties, the place where the contract was concluded, and the place where the services are provided.
